Terms of Service

These Terms of Service ("Terms") form an agreement between you and the Service operator identified above for your use of SpeakCoachLab (the "Service"). By creating an account, accepting these Terms, purchasing access, or using the Service, you agree to these Terms.

1. Eligibility

You must be at least 13 years old to create or use an account. If you are under the age of legal majority where you live, you may use the Service only with permission of a parent or legal guardian who has reviewed these Terms. The Service is not offered to children under 13 under this version of the product.

2. Educational AI service

The Service provides automated debate and public-speaking practice, AI-generated opponents, scores, and coaching. AI content can be incomplete, inaccurate, inconsistent, or inappropriate despite our safeguards. Scores are practice estimates, not official grades, admissions decisions, credentials, or professional evaluations. The Service is educational practice software and is not legal, medical, mental-health, financial, or other professional advice. You are responsible for deciding how to use the feedback.

3. Accounts

Each account is for an independent user. You must provide a valid email address, keep your credentials secure, and promptly notify us if you believe your account has been compromised. You may not share credentials in a way that defeats account limits, sell or transfer an account, or access another person's account without authorization.

4. Your content

You retain your rights in content you submit, such as topics, typed responses, and speech/debate transcripts. You give us a limited, non-exclusive permission to host, transmit, reproduce, analyze, moderate, and otherwise process that content only as reasonably necessary to operate, secure, support, and provide the Service and the coaching you request, and to comply with law. You represent that you have the rights needed to submit your content and that your use will comply with these Terms.

5. Acceptable use

You may not use the Service to violate law or the rights of others; harass or threaten others; submit content you have no right to use; attempt to gain unauthorized access to accounts, systems, models, or data; introduce malware; interfere with security or rate limits; scrape or automate access in a manner we have not authorized; fraudulently obtain credits, refunds, or services; resell access or credits without permission; or use the Service in a way that materially disrupts other users or our providers. We may use automated moderation and other safety controls.

6. Free access, Pro Pass, and practice credits

The current Service includes limited free introductory practice. A 30-Day Pro Pass is a one-time purchase of $7.99 that provides 30 days of Pro access and 50 included practice credits. It does not renew automatically. Pro features currently include Intermediate/Advanced difficulty and additional Debate round options. We may change future prices or features, but changes do not retroactively change a completed purchase unless required by law.

One practice credit generally covers one Debate practice (regardless of whether the selected Debate has 3, 5, or 7 rounds) or one Public Speaking coaching evaluation. Included Pro credits are available during the active Pro Pass and expire when that Pro Pass ends. Extra credit packs are one-time purchases available to buy and use while Pro is active. Purchased extra credits remain saved if Pro expires and become usable again if Pro access is renewed. Deleting an account permanently removes access to remaining digital entitlements, subject to any non-waivable refund or consumer rights.

Administrator-granted support or promotional credits are not purchases, have no cash value, are not refundable, and do not by themselves unlock Pro-only features. Credits are personal to the account and may not be sold or transferred. In some service-failure situations the application may automatically restore a credit; if a credit is not restored and you believe the Service failed to provide the purchased practice, contact support.

7. Payments

Payments are processed by Stripe or another disclosed payment processor. You authorize the processor to charge the payment method you select for the one-time purchase you confirm. We do not operate automatic subscription renewal in the current Service. Prices may be subject to applicable taxes. Payment processing is also subject to the processor's terms and privacy practices.

8. Refunds

You may request a refund from Purchase History. Refund requests submitted through the Service are reviewed individually and, if approved, are processed as a full refund of the remaining refundable purchase amount. The Service does not currently provide customer- or administrator-selected partial refunds through the app. Approval is not guaranteed except where required by applicable law. Approved refunds are returned through the payment processor to the original payment method. While a Pro Pass payment is subject to a pending refund or payment dispute, access related to that purchase may be temporarily suspended and a new Pro Pass purchase may be unavailable until the payment review is resolved. Administrator-granted credits are not purchases and cannot be refunded. Nothing in these Terms limits any refund, cancellation, or consumer right that cannot legally be waived.

9. Service availability and changes

We work to keep the Service available, but AI providers, speech-recognition services, payment systems, hosting providers, networks, and software can fail or become unavailable. We do not guarantee uninterrupted operation, a particular response time, a particular score, or a specific learning outcome. We may maintain, change, add, remove, suspend, or discontinue features when reasonably necessary. If a material change affects an active paid entitlement, we will handle it consistent with applicable law and any stated refund policy.

10. Third-party services

The Service relies on third parties, including AI, payment, hosting, email-delivery, and browser/operating-system speech-recognition providers. Their services may be subject to separate terms and privacy practices. Our Privacy Policy describes the main categories of providers and information processing used by the Service.

11. Suspension and termination

We may restrict or suspend access when reasonably necessary to protect users or systems; investigate suspected fraud, abuse, or security issues; comply with law; address payment disputes; or enforce these Terms. We may terminate an account for serious or repeated violations. Where appropriate, we may provide notice and an opportunity to contact support. You may request account deletion through the Service. Certain transaction, consent, fraud-prevention, security, and audit records may survive account deletion as described in the Privacy Policy.

12. Service intellectual property

The Service's software, interface, branding, documentation, and other operator-provided materials are owned by or licensed to the Service operator and are protected by applicable intellectual-property laws. These Terms do not transfer ownership of those materials to you. Subject to these Terms and applicable third-party rights, you may use coaching and AI-generated practice output you receive for your own lawful personal or educational purposes.

13. Disclaimers

To the maximum extent permitted by law, the Service is provided "as is" and "as available." We disclaim implied warranties to the extent they may legally be disclaimed, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that AI output will be correct, that the Service will meet every user's needs, or that errors or outages will never occur. Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you.

14. Limitation of liability

To the maximum extent permitted by law, the Service operator will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or opportunities arising from use of the Service. To the maximum extent permitted by law, our aggregate liability arising out of or relating to the Service will not exceed the greater of (a) the amount you paid to us for the Service during the 12 months before the event giving rise to the claim or (b) US $50. These limitations do not apply where applicable law prohibits them or to liability that cannot legally be limited.

15. Changes to these Terms

We may update these Terms as the Service or legal requirements change. The version date at the top identifies the current Terms. For material changes, we will provide notice or request renewed acceptance when required by applicable law. Your continued use after an updated version becomes effective may constitute acceptance where permitted by law.

16. Applicable law and consumer rights

These Terms do not waive rights that applicable consumer law does not permit you to waive. Any dispute will be subject to the laws and courts that validly apply to the Service operator and the user; mandatory local consumer protections remain unaffected. We have intentionally not imposed mandatory arbitration or a class-action waiver in this version of the Terms.
